The recent U.S. court ruling that Donald Trump’s emergency tariffs are illegal serves as a major validation for countries, like Canada, that resisted pressure to sign quick, informal trade deals with his administration. The decision suggests that holding out for a better agreement, or challenging the legality of the U.S. position, was a prudent strategy.

Many nations, including key U.S. allies in Europe and Asia, entered into “handshake” agreements to avoid the punishing IEEPA tariffs. These deals often involved accepting import quotas or promising new investments in the United States. The court’s finding that the tariffs were unlawful now undermines the very premise of those negotiations.

For countries that refused to capitulate quickly and instead engaged in prolonged negotiations, the ruling is a boon. It weakens the U.S. negotiating position and confirms that the primary threat being used as leverage was not legitimate. This could embolden other nations to push back harder against unilateral trade actions in the future.
